Effective Date: March 1, 2025
Please read these Terms of Service (“Terms”) carefully before booking an appointment or receiving services from Atrium Physiotherapy and Performance (“we,” “us,” or “our”). By scheduling or attending an appointment, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Services Provided
Atrium Physiotherapy and Performance provides physiotherapy assessment and treatment services (“Services”) delivered by registered physiotherapists in the Province of British Columbia, Canada. All Services are provided in accordance with the standards and regulations set by the College of Physical Therapists of British Columbia (“CPTBC”) and applicable provincial legislation.
We reserve the right to modify, suspend, or discontinue any Service at any time without prior notice. Nothing in these Terms creates an obligation on our part to provide any specific treatment or to continue treatment beyond what is clinically appropriate.
2. Appointments and Cancellation Policy
Appointments are scheduled in advance and represent a reserved allocation of a registered physiotherapist's time. The following policy applies to all bookings:
- Cancellations and reschedules must be made at least 24 hours prior to the scheduled appointment time.
- Late cancellations (less than 24 hours notice) and no-shows may be subject to a cancellation fee at our discretion.
- We reserve the right to cancel or reschedule appointments due to unforeseen circumstances. We will make reasonable efforts to notify you as promptly as possible in such cases.
3. Patient Responsibilities
To receive safe and effective care, patients are required to:
- Provide complete, accurate, and up-to-date health, medical history, and insurance information at the time of assessment and throughout the course of treatment;
- Disclose all medications, supplements, and recent or ongoing medical treatments relevant to their condition;
- Adhere to treatment recommendations, prescribed home exercise programs, and clinical advice provided by their physiotherapist;
- Promptly communicate any changes in their condition, new symptoms, or concerns arising between appointments;
- Conduct themselves respectfully toward all clinic staff, other patients, and visitors; and
- Satisfy all financial obligations for Services rendered, including amounts not covered by insurance.
Failure to meet these responsibilities may result in suspension or termination of Services at our discretion.
4. Payment and Billing
Payment for Services is due at the time of each appointment unless a direct billing arrangement with your insurer has been confirmed in advance. We accept the following forms of payment: major credit cards (Visa, Mastercard), debit cards, and cash.
Where direct billing is offered (e.g., ICBC, WorkSafeBC, or extended health plans), any remaining balance not covered by your insurer remains your responsibility. You authorize us to submit claims to your insurer on your behalf and to collect payment accordingly. We are not responsible for coverage decisions made by third-party insurers.
Invoices and receipts for Services rendered will be provided upon request.
5. Consent to Treatment
Prior to receiving any assessment or treatment, you will be asked to provide informed consent. By attending your appointment and accepting treatment, you confirm that:
- You have been informed of the nature, purpose, expected benefits, and material risks of the proposed treatment;
- You have had the opportunity to ask questions and have received satisfactory answers; and
- You consent voluntarily and may withdraw consent or discontinue treatment at any time, without penalty.
Withdrawal of consent will not affect any financial obligations already incurred for Services received.
6. Limitation of Liability
Physiotherapy involves inherent risks, and outcomes vary based on individual patient factors including diagnosis, health status, adherence to treatment, and other variables beyond our control. We do not guarantee specific results, timelines for recovery, or the success of any treatment plan.
To the maximum extent permitted by applicable law, Atrium Physiotherapy and Performance, its principals, employees, and agents shall not be liable for any indirect, incidental, or consequential damages arising from the provision of, or inability to provide, Services. Our total liability for any claim arising out of or related to these Terms or the Services shall not exceed the total fees paid by you for the specific Services giving rise to the claim.
Nothing in this section limits liability for death or personal injury caused by gross negligence or willful misconduct.
7. Privacy
The collection, use, and disclosure of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the practices described in our Privacy Policy.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.
9. Modifications to These Terms
We may revise these Terms at any time by posting an updated version on our website. The revised Terms will take effect on the date indicated as the effective date. Your continued use of our Services following the posting of updated Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
